Regulation of using our Web site for booking and buying titckets on Lataj.pl

The Internet system of the booking and the purchase of Lataj.pl air tickets is normalised with this regulations and appropriately to the regulation art. 384 § a standard of the tying party to the contract concluded between the Customer, and a Sonata Travel sp. z o.o. constitute 1 Civil Code with registered office in Warsaw on Krucza Rd 41/43 entered in the register of businesses of National Court Register at number 0000039021 hereinafter referred to as the Seller but being an operator of the portal.

Regulation was changed 25-th of november 2009.

Condition of using Lataj.pl website is fully acceptation by a costumer general contractual provisions.

I. Definition used In regulation

1. Lataj.pl - computer system enabling the Customer to search for air links on any routes, in any times, and then to set the airfare, making the booking of the flight and the purchase of the ticket.
2. Airline ticket - confirmation of bilateral agreement between passenger and air line.
3. The sequence of using cupons In airline tickets - The ticket is valid only for the specified airway, from the place of starting a journey to the destination, including all places of the stop predicted in the Ticket in the date of his purchase. The applied rate is suiting the itinerary indicated on the ticket and he constitutes the main element of the agreement of the air transport concluded with the Passenger. The ticket won't be accepted for the accomplishment, if the coupons included in the ticket weren't used in turn of setting them up. If You will not use first flight cupon on the ticket without inform befor that Air Carrer can cancel whole booking.
4. Reservation - ‘folding by the Customer the offer to buy of the ticket /tickets on the route chosen by the Customer, in the service class chosen by the Customer and the rate and dates chosen by the Customer of the travel.
5. Customer - osoba fizyczna lub osoba prawna dokonująca rezerwacji.
6. Passenger - traveler who make a jurney on bouhgt ticket base .
7. Seller - Sonata Travel Sp. z o.o. as the entrepreneur conducting the Internet system of the booking and the purchase of Lataj.pl air tickets. Sonata Travel the llc is a travel agency accredited to IATA (International Air Association Transport – International consisting of an air carriers) and has the right to cause the booking and taking out and the sale of air tickets.
8. Airline - domestic or foreign entrepreneur conducting business activity in the air transport.

II. Cel funkcjonowania systemu

Celem funkcjonowania systemu Customer to establish the appropriate route and the date of the flight, making a booking and the purchase of the air ticket is an aim of functioning of the system.

III. Customer declaration

Customer declares, że:

1. Is civil entyti and have all legal rights or He is legal entyti.
2. Is using truth personal datas .
3. Authorizes the Seller for processing his data and data of the passenger with a view to making a booking and the purchase of the air ticket, and therefore he al. 3 so authorizes the Seller to hand them over to the Haulier to the same purposes.
4. Knows provisions of this regulations, he is accepting them and they oblige to obey them.
5. is using the website Lataj.pl exclusively with a view to searching for proper air links, the inquiry about their price, making a booking and the purchase of air tickets.

IV. Seller declaration

1. The Seller is declaring that he isn't providing a warranty, that using the service will be spending possibilities of the connection with the system running without defects, defects, breaks or the lack booking and as for the fact that the result of searches will cope with expectations of the Customer regarding the technical contents, accuracies or usefulnesses of the obtained information.
   

   The Seller isn't bearing responsibility:

   1. on account of breaks or disruptions in action of the network
   2. on account of the wrong recommendation he/she is driving the Customer of data essential to accept the booking or the purchase of the air ticket
   3. during action or discontinuing air lines, in it for changes be annulling the booking of the Customer
   4. for the non-performance or undue making by the air line of the contract of carriage.
2. The Seller is bearing no responsibility for choice made by the Purchaser of the rate, as well as for meeting the conditions by him for using the withdrawn rate.
3. The Seller is declaring that to the purpose of making a booking or the purchase of the air ticket showing by the Customer his personal details and personal details of the passenger is necessary.
4. Administratorem Danych Osobowych jest Sonata Travel Sp. z o.o. z siedzibą w Warszawie przy ul. Kruczej 41/43.
5. V. The booking and the purchase of the air ticket

1. Choice of the air connection

   With a view to selecting the connection the Customer of the portal is giving the following information in relevant columns: port of the take-off, port of the arrival, date of the take-off, date of the return, number of passengers, type of the rate, favoured haulier, status of the travelling person (e.g. student, child, senior), one's personal details, personal details of the passenger and the e-mail address, as well as the manner of payment for the ticket.

2. Booking - folding the offer to buy of the air ticket

   After making by the Customer of choice of the air link and after submitting the inquiry about the possibility to the booking, he will receive confirming the party of the booking in the form of the message from the Seller e-mail, provided such a booking will be possible. They will be left indicated in the confirmation of a booking in particular:

   2. Airline Ticket price ,
   3. all other costs associated with his purchase (payment for ticket* taking out, possible insurance, extra charge for the shipment of the paper ticket )
   4. booking validity (time for buy the ticket)

   The ticket price is expressed in polish currency. Because of giving by airlines an airport taxes in the USD the price can surrender to minor changes depending on the daily changes of USD.

   (*) Payment for issuing the ticket ("transaction fee") is an extra charge introduced by airlines for the booking and the sale of air tickets; the amount of payment depends on the airline and the route a booked air ticket stayed for which. In the Lataj.pl service the following payments are being charged for booked tickets "transaction fee" without the account what air line is serving the connection:

   per passenger (adult, child, youth, senior):

   • 50 PLN for ticket around country;
   • 80 PLN for ticket around continent;
   • 110 PLN for other tickets;

   Infant (0-2) always travel without extra fee (!)

   The confirmation of a booking isn't an air ticket and he doesn't authorize the travel for good manners. Because of the dynamic division of places in aeroplanes carried out by Carriers, they can one-sidedly shorten the life of the booking (pkt.d).

3. Purchase of the ticket

   A moment of issuing the air ticket is regarded as the moment of the purchase of the ticket and conclusions of the contract of carriage. tickets are issuing : monday - friday 8.00 till 20.00 and saturday 10.00 tll 17.00. In extraordinary *, situations, independent of the operator of the portal, the ticket price is subject to change in the life of the booking, i.e. between booking the ticket and the date of taking out. If this is the case the Customer immediately will be informed of the possibility of the extra charge of the difference or withdrawing payed wholes of amounts and giving the transport from concluding a contract. The customer isn't entitled from this title to a compensation.

   (*) Behind extraordinary situations he is entertaining one another in particular: change of fuel and airport payments enforced by Carriers cold.

4. Canecel reservation

   By the Customer

   The customer has the right to cancel a booking at any moment without financial consequences to the moment of issuing the air ticket. After the conclusion of the contract of carriage cancelling a booking and the turn of the ticket are possible on conditions determined in the VIII section.

   By the seller

   The confirmed booking can be withdrawn by the Seller in the period of her importance only in the event that the Carrier cancels a flight, he will change or he will withdraw the rate withdrawn by the Customer. In this situation for the Customer from this title a whole of payed amounts isn't entitled to a compensation but only a return towards the ticket.

VI. Ways and conditions for payment

1. Credit Card payment

   • kod CVC/CVV (3-ostatnie cyfry z paska podpisu)

VII. Delivering the air ticket

1. All tickets realizowne through Lataj.pl are electronic tickets. The issued ticket is always sent to the e-mail address given in the booking. In case of the mistake or the disagreement of the address, Lataj.pl isn't bearing responsibility too non-delivery of document into the electronic box of the Customer (of limiting in the mains movement, the firewall or sensitive antispam rules). The customer can independently print his ticket logging into the outside system: www.checkmytrip.com which it is possible to use by giving the number of the booking and the surname of the passenger on the homepage www.Lataj.pl
2. The customer can, after emphasizing the appropriate option in the process of making the booking, to interpret the purchased ticket personally in points of the service of the Seller.
3. In case of the impossibility of issuing the electronic ticket, the Seller will get in touch immediately with the Customer with a view to establishing the more further acceptance procedure of the ticket.

VIII. Return of the purchased ticket

1. The customer has the right to return the purchased air ticket provided that conditions determined by the Carrier for the given rate are allowing to it.
2. The rate determines moreover, whether and what part loss of the settled amount due for the returned ticket will take place in before or after the starting date of the first section of the journey.
3. In order to have claim ticket refund, customer is obliged to send in writing a statement, she/he would like to have her/his tickeet refunded. Such statement has to be sent to fax number +48 22 201 11 63 or to e-mail address rezerwacje@lataj.pl
4. Return of the the ticket, after making possible deductions, is taking place depending on it in what way a made payment for the ticket stayed:
   
   
   1. in case of making a payment with cash - the return is taking place in the point of the service of the Seller, in which the payment for the ticket took place.
   2. in case of making a payment with transfer - the return is taking place to the banking account shown by the Customer in the time of 14 days from the date of the application.
   3. in case of making a payment with credit card - the return is taking place through the account crediting of a credit card, from which the payment was made, in time to 30 days from the date of the return of the ticket.

IX. Responsibility rules

1. The Seller is bearing no responsibility on account of not going on a tour from causes lying on the side of the Haulier, because of giving by the Customer false data essential to issue the ticket or of not meeting the requirements typical of the rate withdrawn by him by the Customer, of region of the travel (the visa regime or other essential licences for entry), because of the force majeure, the strike or the lock-out of employees of the Carrier or employees of the ground crew of the airport.
2. All disputes between sides will be settled by competent courts of general jurisdiction on account of the registered office of the Seller.
3. In not settled matters provisions of the civil code are applicable to this Regulations.
